SC Delish Experiences SRL reserves the right to modify these Terms of Use, with or without notice. The latest version of the Terms and Conditions will replace the previous versions.
INTRODUCTION
This site is maintained and managed by SC Delish Experiences SRL, a limited liability company established and validly registered in Romania, having its registered office in Str. Doinei, nr. 78B, sc. 1, et. 2, ap 19, Sat Fundeni, Com. Dobroesti, Jud. Ilfov, Romania, registered with the Trade Register under no. J23 / 310 / 03.02.2017, Ilfov, having the unique registration number 36983980.

DEFINITIONS
User is an individual who uses the www.delishexperiences.com web site and is registered with a user account.
Event is a package of services that includes but is not limited to: tasting food and / or drinks at a single restaurant, presenting the dishes and / or the restaurant.
Tour is a package of services that includes but is not limited to: tasting food and / or drinks at several restaurants, presenting the dishes and / or the restaurant.
Customer is a person/ company who, on the basis of a reservation, benefits from the services provided by SC Delish Experiences SRL
Restaurant is used with a larger meaning and is not limited to: restaurant, grocery store, café, teahouse, etc.
THE PURPOSE OF THE SERVICES
SC Delish Experiences SRL provides events and culinary tours in which users / customers can taste foods and / or drinks specific to independent restaurants – “partner restaurants”, located in Bucharest as well as in the surroundings of Bucharest.
Through the services provided by SC Delish Experiences SRL we aim to connect you with the partner restaurant, which is fully responsible for the quality and freshness of the dishes and drinks served from SC Delish Experiences SRL offers the above-mentioned services within a range of culinary packages (standard or custom), which include stops at one or more restaurants, giving details of the food and/ or drinks tasted.
The services provided by SC Delish Experiences SRL and offered to customers who use the Web site or “Users” include, but are not limited to, food tours, services related to searching and obtaining access to information in the form of, but not limited to, text, video, pictures, partner restaurant menus, restaurant work schedule as well as other services as they can be provided periodically by SC Delish Experiences SRL.

The entire content of www.delishexperiences.com – images, texts, graphics, symbols, web graphics, scripts, programs and other data – is the property of SC Delish Experiences SRL and its partners and is protected by the Law on the Protection of Rights Author and laws on intellectual and industrial property. Use of any of the items listed above without the consent of SC Delish Experiences SRL is punishable under the laws in force.
SECURITY OF PERSONAL DATA
User reservation data is confidential.
SC Delish Experiences SRL and its partners will use your personal data only for the stated purpose of this site. The information in the booking form will be used to send you the booking confirmation of the event or food tour, invoice, news and any promotions, as well as any other information or changes related to your booking. SC Delish Experiences SRL undertakes not to make public and sell the databases containing information regarding the personal data of its clients.
Registration for receiving periodic newsletters by e-mail, written messages (SMS), post or other means of communication is optional. The user / customer is the one who will request his / her registration in the database for receiving the periodic newsletters.
However, personal data may be transmitted to authorities in charge of verifying commercial transactions or other lawful authorities to perform any legitimate verification under the law if required under applicable law.
Booking dates must be carefully filled out. SC Delish Experiences SRL can cancel without notification the reservations made with erroneous data.
SC Delish Experiences SRL may also cancel any reservation made by a user who cannot be contacted by telephone or e-mail in connection with the reservation, but not if the user has made reservations through SC Delish Experiences SRL and has been honored them or if the services reserved have been paid in advance.
WEB – SITE ACCESS
SC Delish Experiences SRL warrants to the user limited access to this site for personal interest and does not give him/her the right to download or partially or completely modify the site, to duplicate the site as a whole or partially, to copy, sell / resell or exploit the Site in any other manner, for commercial purposes or against the interests of SC Delish Experiences SRL.
If you use the website www.delishexperiences.com you are responsible for maintaining your account and password confidential and you agree to take responsibility for all activities that take place in your account or by using your password. The representatives of SC Delish Experiences SRL and their partners reserve the right to refuse services, cancel accounts or bookings that do not comply with the company policy.
The terms and conditions of use apply to all site users. The site may contain links to third-party sites that are not owned or controlled by SC Delish Experiences SRL.
SC Delish Experiences SRL has no control over, and does not take responsibility for the content, privacy policies or practices of third party sites. In addition, SC Delish Experiences SRL cannot censor or edit content on any third party site.

CREATING A USER ACCOUNT
SC Delish Experiences SRL enables users to create a user account for making reservations.
For the creation of the user account, all required data and information required in the registration procedure will be provided. SC Delish Experiences SRL does not oblige anyone to provide this data and information, but reserves the right to prevent the opening of the user account in the absence of the requested information and data.
The user is only required to provide real-time data and information, and in particular not to provide identification data that does not belong to him/her (for example, not to use a name, an email address or a fake phone number or data belonging to another person, and not to log in with fake profiles or belonging to other people). Therefore, SC Delish Experiences SRL reserves the right to verify the authenticity of the data and information provided by users in the user account creation procedure as well as the right to refuse to open a user account if the information provided is unrealistic or, to suspend or close such an account.
You will complete all fields marked as mandatory in the electronic registration form. Any fields may be modified by the registered user after creating the User Account at any time during the registration or use of the web site. A User Account with a password and username / email address will allow the registered user to access the web site. In case of refusal to provide the mandatory information required during the registration of the User Account, SC Delish Experiences SRL is entitled to refuse the registration.
When creating a User Account, you will be prompted to tick the “I’ve read and accept the Terms and Conditions” field. By checking this field and by clicking on the “Register” button on the form, you will agree explicitly and voluntarily with the terms and conditions of the Terms of Use, stating that you have read these Terms and Conditions and that you compel them to be respected. SC Delish Experiences SRL may keep log files with the IP address of the Users on its servers as well as any other information necessary to identify the Registered User and reproduce the User’s Terms of Service agreement in the event of litigation.
If you do not create a User Account, you will be able to book the tour/event by filling in the mandatory data and you will be prompted to tick the “I’ve read and accept the Terms and Conditions ” field. By checking this field and by clicking on the “Book now” button on the form, you will explicitly and voluntarily agree to the terms and conditions of the Terms of Use, stating that you have read these Terms and Conditions and that you are obligated to respect. SC Delish Experiences SRL may keep log files with the IP address of Clients on its servers, as well as any other information necessary to identify the Customer and reproduce the User’s agreement on the Terms and Conditions of Use in the event of litigation.
The registration of individuals with little or no exercise capacity (such as people between 14 and 18 years of age) as Users registered on the web site is not allowed. Parents exercising custody rights, guardians or legal representatives of that minor are responsible for all damages caused by the latter to SC Delish Experiences SRL, collaborating restaurants and any third parties in the process of registering or using the services, as well as for all damages which derive from false data or any false or misleading statement.
The registered user guarantees that the information provided at the time of registering the User Account is true, complete and accurate.
After creating a User Account, the Registered User will receive a confirmation by email that will include the name of the legal entity, registered office, registration number and Delish contact details, and a link to the text of these Terms and Conditions and Privacy Policy , as well as a validation link.
LIMITATION OF LIABILITY
SC Delish Experiences SRL makes every effort to ensure that the information available on the web site is accurate and up-to-date, but does not guarantee the authenticity and completeness of the content and does not assume any terms for updating the information, unless otherwise specified on the web site.
SC Delish Experiences SRL will not be liable for any damages or loss of profit suffered by the User/ Client or any third party arising as a result of the termination, modification or limitation of services or deactivation of the User Account due to the User/ Client violation of these Terms And Terms of Use or applicable law, or due to information or decisions issued by competent authorities.
SC Delish Experiences SRL is not responsible for damages suffered by the User / Client or any other person as a result of confidentiality regarding the use of this site. Any information that the User discloses on the site may not be safe during its transmission over the Internet. Third parties have the ability to intercept the transmissions that the User makes when using this website.
SC Delish Experiences SRL will not be liable for the content and information of any third party, including, but not limited to, advertisements, banners or other promotional materials placed on the web site.
RESERVATIONS
Reservations will be made by Users / Clients through the web site. For the avoidance of doubt, any reservation made by a User must be confirmed by SC Delish Experiences SRL by email, sms, telephone or by notification on the web page.
The user understands and accepts that a reservation may not be confirmed in situations such as but not limited to: medical problems encountered by SC Delish Experiences SRL personnel, which make impossible the gastronomic tours requested by the user, the maximum occupancy of the restaurants was reached, the restaurant is closed or organizes private events and / or in any other case, regardless of the commitments made to SC Delish Experiences SRL. In such a situation, we will try to notify the Client as soon as possible about the impossibility of doing the tour and / or we will offer him the option of choosing one of the options: booking a new culinary tour at the same price or at a higher price (if Client will make the payment of the difference), or the return of the amounts paid by the Client within maximum 30 days.
The Client undertakes to honor the reservations that have been confirmed by SC Delish Experiences SRL, and if the Client cannot honor it, service cannot be cancelled, SC Delish Experiences SRL will not reimburse the Client for the amounts paid by him / her for the event/tour.
RIGHTS AND OBLIGATIONS
Users commit themselves to:
A. Use the RESERVATION web site in good faith, in compliance with the applicable legal provisions and only for the purpose in which it was created;
B. Use the application for personal use only;
C. Mention in the booking form whether it has food or beverage allergies;
D. Read carefully the description of the event/ tour prior to booking because for the events with a set-menu sometimes might not be possible to offer you other options. Where possible, we replace the dishes with other alternatives. Keep in mind that this will not always be possible for all dishes.
E. The client will make the difference between allergies and dietary options. No specific menus (vegetarian, lacto-octo-vegetarian) are available for events /standard tours , except for an organized group that has received a personalized offer.
F. Not to sell the information obtained through the application and not to use this information to make unfair competition with SC Delish Experiences SRL or the collaborating restaurants;
G. Not to make any reservation if, in accordance with legal provisions, they are not of the age necessary to enter or to eat in a particular restaurant;
H. Make reservations in good faith and honor all bookings made via the web site or, as the case may be, cancel the reservations they cannot honor;
I. Write only real reviews and show good faith in writing;
J. To pay for the services provided by SC Delish Experiences SRL within the agreed term.
SC Delish Experiences SRL undertakes:
A. Provide the services as mentioned in the event/tour description;
B. To provide the customer with as much information as possible on the web site so that the customer can make an informed decision.
LIMITATION OF RESPONSIBILITY ON RESTAURANT SERVICES AND USER – RESTAURANT RELATIONS.
SC Delish Experiences SRL does not respond in any way for: the User/ Client – Restaurants relationship after accepting the event/ tour reservation; the impossibility of booking the restaurant after its acceptance, the quality of the food and drink served; Restaurants and / or other services.
For the avoidance of doubt, the User/ Client understands and accepts that SC Delish Experiences SRL takes over the information about the Restaurants from them and cannot be held responsible if any information about them is not correct (such as address, telephone number, number of places , Images, menu, etc.). At the same time, SC Delish Experiences SRL cannot be held responsible for any other information made public within the web site if it is taken over from third parties.
Last but not least, the User/ Client understands and accepts that SC Delish Experiences SRL offers a culinary event / culinary tour, but has no control over how the Restaurant caters to the services offered (menu etc). For this reason, SC Delish Experiences SRL cannot be held responsible if a reservation cannot be honored or is inappropriately honored by the Restaurant.
PRICES
The displayed price is final for event / tour, with all costs included for the service package, less fees like charge-back.
Prices are displayed in and paid in Romanian lei (RON).
PRIVACY POLICY
SC Delish Experiences SRL collects and processes the personal data of the web site users, in accordance with Law no. 677/2001 on the protection of personal data, with subsequent amendments and completions, Law no. 506/2004 on the protection of personal data and the protection of privacy in the electronic communications sector, with subsequent modifications and completions, as well as in compliance with any other applicable normative acts.
SC Delish Experiences SRL undertakes to respect all the rights and obligations of users whose personal data are collected and processed as regulated by law.
AGREEMENT ON THE COLLECTION OF PERSONAL DATA
By downloading, installing and / or using the web site and / or, as appropriate, by ticking the “I have read and accept the terms and conditions” section in the user account creation process, users accept this Privacy Policy.
You can always opt out of collecting and processing your personal data or you can request: deleting collected data, stopping the processing of collected data, transforming data collected in anonymous data. In such a situation, you may not be able to use the web site anymore.
USERS RIGHTS CONCERNING THE DATA THAT ARE COLLECTED AND PROCESSED
SC Delish Experiences SRL guarantees to the users all the rights recognized by the law regarding the collection and processing of personal data. According to Law no. 677/2001 you have the following rights: the right of access to personal data, the right to interfere with personal data, the right to oppose, the right not to be subjected to an individual decision, the right to address to justice, any other rights provided by law.
At the same time, SC Delish Experiences SRL warrants that it will not send unsolicited spam (spam) as defined by law and that it will do all due diligence to keep users safe data.
You may request at any time information on personal data collected and on their transfer to third parties
DATA STORAGE AND TRANSFER
Data collected and processed will be stored on the Romanian territory.
Data collected and processed can be submitted to SC Delish Experiences SRL partners (affiliated legal entities, restaurants and / or other partners) only if the transmission of these data is required in connection with the event / culinary tour.
If the collected data will be transferred to the partners of SC Delish Experiences SRL, we will require them to observe the same rights granted by the law regarding the collection and processing of data. They will be solely responsible for complying with the applicable law.
DISPUTES AND CONFLICTS
By using (visiting or booking events & tours) of the site, the user agrees that the Romanian laws will govern the Terms and Conditions of Use above and any dispute of any kind that may arise between the user and SC Delish Experiences SRL and its associates / partners / affiliates. In the event of any conflict between SC Delish Experiences SRL and its clients, first try to solve them amiably. If amiable settlement will not be possible, the dispute will be settled by the court within the territory where SC Delish Experiences SRL is registered, in accordance with the applicable Romanian laws.
FINAL PROVISIONS
If any of the above clauses are found to be null or void, irrespective of the cause, this clause will not affect the validity of the other clauses.
With the submission of the event / tour reservation form, the customer accepts without any objections the conditions and terms of use, the value of which is the same as a valid contract.
